Alert: U.S. Department of Education Releases Final Title IX Regulations

On April 19, 2024, the United States Department of Education (“USDOE”) released its long-awaited Final Title IX Regulations regarding gender-based harassment and discrimination. The regulations will become effective August 1, 2024. At this time, the rulemaking process remains ongoing for the USDOE regulation regarding athletics.

In part, USDOE notes that the final regulations (1) protect against all sex-based harassment and discrimination, by restoring and strengthening full protection from sexual violence and other sex-based harassment; (2) promote accountability and fairness, by requiring schools to take prompt and effective action to end sex discrimination in education programs or activities, prevent its recurrence, and remedy its effects; and (3) empower and support students and families, by implementing measures to protect against retaliation for exercise of Title IX rights, requiring communications of nondiscrimination policies and procedures, and protecting student privacy.
