Weston Hurd’s Assistant Managing Partner, Mark Kruse, is an experienced attorney and litigator. Prior to joining the firm in 2017, Mark was a partner with Kahn Kruse Co., LPA since the 1980s. Mark represents his clients in both state and federal courts throughout the United States, and is admitted to the Ohio Bar, various United States District Courts, and the Sixth Circuit Court of Appeals.
Mark’s clients are engaged in a variety of industries and principally include construction (general contractors, subcontractors, materialmen, owners and developers, including development of contracts and addressing claims of defective construction, schedule delay/disruption/acceleration, poor workmanship, incomplete or incorrect work, unapproved change orders, site condition issues, performance and payment bonds, mechanic’s lien issues, and bid disputes), environmental and waste management services, manufacturers, distributors, and commercial property owners. Mark handles a wide range of complex construction, business, and commercial disputes, with areas of concentration including litigation, complex contract disputes, business torts, commercial real estate issues, business and partner issues (including break-up and wind down), asset purchases/sales, fiduciary claims, corporate director & officer liability/defense, lien issues, employment related claims, insurance coverage issues, and intellectual property protection and trade secret litigation.
Mark’s practice includes the preparation, review, and negotiation of complex business and construction related contracts, including prime and subcontracts, AIA documents, master services agreements, transportation and hauling agreements, waste management agreements, distribution agreements, lease agreements, and purchase agreements. In his representation of business clients Mark also handles real estate transactions and disputes, and the sale/acquisition of businesses.
Mark has significant experience in resolving disputes through various types of alternative dispute resolution, including mediation, arbitration, and litigation.
